Terms and Conditions Eindhoven Taxi Snel

Please read these terms carefully before using our services. If you use our services, you agree to these terms and conditions.

1. Definitions

1.1. Entrepreneur
Eindhoven Taxi Snel, located at Lichttoren 32 in Eindhoven and registered with the Chamber of Commerce under number 80397298.

1.2. Customer
Visitor, natural person or legal entity, who places one or more bookings via eindhoventaxisnel.nl and thus concludes a transport agreement with the carrier.

1.3. Parties
Entrepreneur and customer together.

1.4. Booking
Placing one or more journey orders via eindhoventaxisnel.nl whereby the entrepreneur carries them out himself or forwards them to the carrier and thus plays a facilitating role.

1.5. Ride
Transport by taxi booked by the customer with the entrepreneur.

1.6. Carrier
A company that performs a ride for an entrepreneur.

1.7. Driver
The person deployed by the carrier to carry out the journey.

2. Services

2.1. The entrepreneur makes it possible for the customer to book a ride with the entrepreneur or one of its carriers.
2.2. The entrepreneur acts both as an intermediary and as a carrier between customer and carrier.
2.3.​ The transport agreement is concluded between the customer and the carrier by placing a journey order by the customer via eindhoventaxisnel.nl.
2.4.​ The customer acknowledges that the carrier is not employed by the entrepreneur.

Applicability

3.1. The general terms and conditions apply to the booking and purchase of rides by the customer via eindhoventaxisnel.nl.
3.2. The customer accepts the applicability of these general terms and conditions as soon as the customer places a booking via eindhoventaxisnel.nl and therefore enters into a transport agreement with the carrier.
3.3.​ The provisions of these general terms and conditions apply in full; these provisions can only be deviated from in writing after explicit written approval from the entrepreneur.
3.4. The general terms and conditions are made available to the customer digitally before he makes a final booking.
3.5. Unless expressly agreed otherwise in writing, the applicability of other general terms and conditions is excluded.
3.6. If one or more provisions of these General Terms and Conditions are at any time wholly or partially void or should be annulled, the other provisions of these General Terms and Conditions will remain fully applicable. In that case, the Customer and the Entrepreneur will enter into consultation to agree on the replacement of the void or voided provisions. The aim and purport of the original provisions will be taken into account as much as possible.
3.7.​ In the event of uncertainty regarding the interpretation of one or more provisions of these General Terms and Conditions, the explanation must take place in the spirit of these terms and conditions.
3.8. If a situation arises between the Customer and the Entrepreneur that is not regulated in these General Terms and Conditions, this situation must be assessed in the spirit of these terms and conditions.
3.9. Entrepreneur may change these General Terms and Conditions from time to time. The amended version will be published on eindhoventaxisnel.nl and applies to the Booking placed by the Customer. The Customer is advised to read the General Terms and Conditions (again) before placing a (new) Booking.

4. Customer requirements

4.1. When placing a ride order via eindhoventaxisnel.nl, the customer enters a valid e-mail address and telephone number where he or she can be reached. The Customer is responsible for the correctness of his data, as well as for the correctness of placing a Booking.

5. Entrepreneur obligations

5.1.​ The entrepreneur will make every effort to ensure the proper functioning of eindhoventaxisnel.nl, but cannot guarantee that it will function fully and uninterruptedly at all times.
5.2.​ The Customer can ask the Entrepreneur questions and submit complaints about the handling of the Booking and/or the Carrier’s service.
5.3. Entrepreneur is responsible for processing online paid and on-account rides of the Customer with regard to the Booking placed by the Customer. The entrepreneur bears the debtor risk in the event of non-payment by the Customer and is entitled to initiate collection measures.

6. Booking a ride

6.1. The Customer can book a Ride with the Entrepreneur via the online booking system at eindhoventaxisnel.nl.
6.2.​ For Trips from the airport, the Customer must provide the flight details when placing the Trip Order so that the Carrier can take this into account. The Customer is also free to determine the desired collection time, which is leading for the Carrier.
6.3.​ After the Booking, the Customer immediately receives an automatic confirmation of the booked Ride at the specified e-mail address.
6.4. The Customer is responsible for the correctness of his data, as well as for the correctness of placing his Booking. The entrepreneur is not liable for incorrect (flight) data provided by the Customer.
6.5. It is possible to take extra baggage and/or special baggage with you during the Ride. The Customer must indicate this when booking the Ride. If it is not possible to take it with you, the Entrepreneur will contact the Customer and a solution will be sought.
6.6.​ If the Customer takes so much luggage with him that it is necessary to use a minibus or several taxis, the Customer must ensure that he books the correct transport category or several taxis. If this has not happened, Eindhoven Taxi Snel is entitled to charge extra costs for this.
6.7.​ It is possible to take small children with you during a Ride. The customer is responsible for bringing a child seat with him.

7. Canceling or changing a ride

7.1. The Customer has the right to change or cancel the Ride up to 2 hours before the agreed pick-up time. Any amounts paid will be refunded in full (minus any transaction costs). A cancellation must be made by telephone or via the online cancellation environment of Eindhoven Taxi Snel. A link to this is included in the confirmation email.
7.2.​ If the pick-up location of the Ride is changed, additional costs will be charged if the pick-up location is further from the destination.
7.3.​ If the Ride is canceled less than 2 hours in advance, the Customer is not entitled to a refund.

8. Execution of a ride

8.1. The driver will pick up the Customer at the agreed time, at the front door of the address specified by the Customer. If this place is not accessible by vehicle, the Driver will park his vehicle as close as possible and inform the Customer about this.
8.2.​ At Rides from the airport, the driver calls the customer to find each other. Customer must ensure that his or her mobile phone is switched on again as soon as possible after landing.
8.3.​ The Trip is carried out in accordance with the ​General Terms and Conditions for Taxi Transport of the sector organization KNV Taxi​. If these Terms differ in any respect from these Terms and Conditions, the latter shall prevail.
8.4. If no taxi has arrived at the Customer 10 minutes after the agreed time, the Customer must always contact the Carrier via the number provided. If telephone contact fails or the Carrier indicates that the taxi will not arrive on time, the Customer must contact the central number of Eindhoven Taxi Snel. The Customer will find this number in the confirmation email. A solution will then be sought together.

9. No show and driver waiting time

9.1. Customer is not entitled to a refund if there is a ‘no show’. There is a no show if the Customer is not present at the agreed location within ten minutes after the agreed pick-up time. In the meantime, the Carrier is obliged to make demonstrable attempts to contact the Customer.
9.2.​ For transport from the airport, a different waiting time applies to the Driver, namely one hour and ten minutes after landing of the Customer’s flight. The flight details provided by the Customer at the time of Booking serve as a starting point. Carrier will monitor the flight. The Customer is also obliged to keep the Carrier informed of delays at the airport by calling the telephone number stated on its confirmation email.
9.3.​ In the event of a longer waiting time than one hour and ten minutes after the aircraft has landed, the Driver is entitled not to have to wait any longer and it will be regarded as a no show. In consultation with the Customer, it can be agreed to wait. The driver is entitled to request redundancy pay for this, which can be paid in cash in the taxi.
9.4. If the actual landing time differs to such an extent (at least 3 hours) from the original landing time that it becomes difficult for the Carrier to carry out the Trip, a solution can be sought in consultation with Eindhoven Taxi Snel. If this fails, the Carrier is entitled not to have to carry out the Trip and the Trip will be cancelled. The customer will hereby receive a full refund of the amount paid, but is responsible for arranging (and paying for) replacement transport.

10. Payment

10.1.​ A Trip booked by the Customer with the Entrepreneur can be paid as follows;
10.1.1​. Cash in the taxi
10.1.2.​ Pinning in the taxi
10.1.3.​ Credit card in the taxi
10.1.4. Online in advance with iDEAL
10.1.5. Afterwards by invoice

10.2.​ Costs for extra kilometers driven due to the change of the route by the Customer after he has boarded the driver, must be paid directly to the driver.
10.3. Any gratuities are not included in the price. The customer is free to decide whether or not to tip the driver and the amount thereof.

11. Liability

11.1. Entrepreneur acts both as an intermediary and as a carrier. The contract of carriage is concluded between the Customer and the Carrier after the Customer has placed a Booking via eindhoventaxisnel.nl.
11.2.​ The Entrepreneur is not liable for any form of damage, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise arising from the use of the (transport) services offered by the Carrier. services. This responsibility and liability rests with the Carrier, in accordance with Article 12 of the General Conditions for Taxi Transport of KNV Taxi.
11.3.​ Entrepreneur is not liable for delays or shortcomings resulting from causes over which it reasonably has no influence.
11.4. Under no circumstances will the total liability of the Entrepreneur for services provided to the Customer exceed two hundred and fifty euros (€ 250).

12. Privacy

12.1. Entrepreneur will respect the privacy of the Customer and handle the (personal) data obtained with care.
12.2. When Booking the Trip, the Customer agrees to provide the necessary personal data to the Carrier.
12.3. The Entrepreneur reserves the right to approach the Customer for matters such as newsletters, competitions, presents, et cetera. This can be done both online and offline, but only at the (email) addresses provided by the Customer.

13. Applicable law

13.1. These General Terms and Conditions and the Agreement between Customer and Entrepreneur are governed by Dutch law.
13.2. Any dispute arising from or related to these General Terms and Conditions and/or Agreement will be submitted to the competent court in the place of business of the Entrepreneur.
